AMA Appeals
The Veterans Appeals Improvement and Modernization Act, commonly called the AMA, was introduced to make the VA appeals process faster and more structured. Before the AMA, appeals often took years to resolve, leaving many veterans waiting for the benefits they had earned. The Three Review Options
Under the AMA, veterans have three main options after receiving a decision on their claim.
- Higher-Level Review – This allows a more senior VA reviewer to re-examine the claim using the same evidence already on file. Veterans cannot submit new evidence with this option, but it can help if they believe the initial decision was made in error.
- Supplemental Claim – Veterans can add new and relevant evidence that was not part of the original claim. This might include updated medical records, additional lay statements, or independent medical opinions. The VA will then review the new evidence along with the original file.
- Appeal to the Board of Veterans’ Appeals – Veterans can appeal directly to the Board, where a Veterans Law Judge reviews the case. There are further choices within this option: a direct review without new evidence, a review with additional evidence, or a hearing before a judge.
Timelines Under The AMA
One of the most significant changes under the AMA is the expectation of shorter timelines. Higher-Level Reviews and Supplemental Claims are often resolved within four to five months, while Board appeals may still take longer, especially if a hearing is requested. Although timelines vary, the structure of the AMA provides more predictability than the old system.
