Types of VA Asbestos Cases We Handle in Miami

Asbestos was used across every branch of the U.S. military for decades. Veterans who worked in shipyards, in insulation work, in construction, in mining, in milling, or in demolition of older buildings may have been exposed during their service. If you served in Iraq or other regions where older structures were damaged, airborne fiber exposure was also possible.

  • Mesothelioma. This aggressive cancer of the lung lining is almost exclusively caused by asbestos exposure. It can take 20 to 50 years to develop, which often makes the service connection harder to establish, especially when older records are incomplete. Mesothelioma is directly linked to prolonged asbestos fiber inhalation.
  • Asbestos-related lung cancer. Inhaled fibers cause cellular damage over time. Veterans who worked in engine rooms, shipyards, or around pipe and boiler insulation are among the highest-risk populations. Asbestos lung cancer VA claims require specific medical documentation connecting the diagnosis to service exposure.
  • Asbestosis. Chronic scarring of the lung tissue with no cure. Symptoms worsen over time, and the condition often requires long-term medical management. We help veterans document the severity and tie it back to their military occupational history.

VA asbestos claims are governed by federal law, not state law. But there are procedural rules that matter significantly for Miami veterans.

Service connection under 38 C.F.R. § 3.303. Under federal VA regulations, establishing service connection requires three things: evidence of a current diagnosis, evidence that an in-service event occurred (in this case, asbestos exposure), and a medical nexus opinion linking the two. For asbestos cases, that nexus opinion typically needs to state that the condition is “at least as likely as not” caused by in-service exposure. Without that specific language, many claims fail. Per 38 C.F.R. § 3.303, VA must consider the places, types, and circumstances of military service in making that determination.

No presumptive status for asbestos. Unlike Agent Orange or certain burn pit conditions, asbestos exposure is not covered by VA presumptive service connection rules under 38 C.F.R. § 3.307 and 3.309. That means every asbestos claim must be individually proven. Evidence must show both in-service exposure and a current disabling condition tied to that exposure. This is precisely where having an attorney makes a real difference.

Appeals timelines. Once the VA issues a rating decision, veterans generally have one year to file a supplemental claim, request higher-level review, or appeal directly to the Board of Veterans’ Appeals. Missing that window can cost you significant back pay and benefits. If the Board denies the claim, veterans have 120 days to file a notice of appeal with the Court of Appeals for Veterans Claims.

Understanding where you are in this process matters. And the earlier you have legal representation, the better your chances of avoiding procedural mistakes that could jeopardize your claim.

What Damages Are Recoverable in a Miami VA Asbestos Claim?

VA disability compensation for asbestos-related conditions can be substantial, particularly when the illness is severe or permanently disabling.

Economic damages. Monthly VA disability payments are calculated based on your combined disability rating. For 2026, the compensation rate for a single veteran with a 100 percent rating is over $3,700 per month, with additional amounts for dependents. Veterans rated at 100 percent due to mesothelioma or severe asbestosis receive this benefit tax-free for life. Back pay can be awarded going back to the date your claim was first filed, which in some cases means substantial past-due benefits.

Special Monthly Compensation (SMC). Veterans whose asbestos-related illness causes the loss or loss of use of certain body functions may qualify for SMC above and beyond the standard disability rate. Veterans on home oxygen or requiring aid and attendance due to respiratory disease are common examples. SMC can add hundreds to thousands of dollars per month to a veteran’s benefit.

VA healthcare. Service-connected veterans receive VA healthcare for their connected conditions, which for asbestos-related diagnoses like mesothelioma can include chemotherapy, surgery, palliative care, and long-term respiratory support. This benefit has real dollar value separate from disability compensation.

Accrued benefits and survivor claims. If a veteran passes away before a pending claim is resolved, surviving spouses and dependents may be entitled to accrued benefits and Dependency and Indemnity Compensation (DIC). Punitive damages are not available in VA disability claims, which are administrative rather than civil proceedings.
